Prosecutors said Flynn had committed to a false story weeks before the January 24, 2017, interview with the FBI, having lied several times already to White House officials about his dialogue with ambassador Sergey Kislyak and then repeating those falsehoods to federal agents. Former Trump foreign policy adviser George Papadopoulos left prison on Friday after completing his 14-day sentence.

"A sitting National Security Advisor, former head of an intelligence agency, retired Lieutenant General, and 33 year veteran of the armed forces knows he should not lie to federal agents", the filing continued.

We can hope that Sullivan shames Mueller for his prosecutorial abuse and decides that the Federal Bureau of Investigation interfered with Flynn's constitutional right to counsel.

Mr. Trump has been critical of the special counsel's investigation into Flynn, saying on Twitter on Thursday that the special counsel's office "gave General Flynn a great deal because they were embarrassed by the way he was treated". His lawyers are citing Flynn's acceptance of responsibility and his extensive cooperation.

Given both men's extensive conversations with prosecutors, and their involvement in key episodes under scrutiny, the pair could pose a threat to the president, who in addition to Mueller's investigation is entangled in a separate probe by prosecutors in NY into hush-money payments paid to two women who say they had affairs with Trump.

If it indeed proves to be the case that Flynn and his legal team received these exculpatory documents only after pleading guilty because Judge Sullivan ordered Mueller's team to turn over anything they'd been withholding, not only is this case going to be tossed, the federal prosecutors involved in it are going to face legal discipline for their behavior.

Flynn later said he had lied.

After a Washington Post report on January 12, the special counsel's office wrote, Flynn "repeated the same false statements to multiple members of the Presidential Transition Team, including Vice President-Elect Michael Pence, incoming White House Chief of Staff Reince Priebus, and incoming White House Press Secretary Sean Spicer".

He was the first senior White House official to be charged in special counsel Robert Mueller's investigation into Moscow's interference in the 2016 presidential election, and he was the first to officially agree to cooperate with investigators. Around the same time, President Donald Trump's former attorney Michael Cohen pleaded guilty to eight federal charges.

Tuesday's defense filing did not contain new information about Flynn's cooperation or provide a full explanation for why he made false statements to investigators.

The filings also hinted at various other lines of inquiry, with NY prosecutors noting that "Cohen further declined to meet with the office about other areas of investigative interest" - matters that may prompt questions from the judge on Wednesday. Trump's one-time personal lawyer is set to be sentenced in NY tomorrow.

The reference was to then-FBI Director James Comey's admission to lawmakers that FBI agents didn't believe Flynn lied during the interview.
